Highlights of new legislation that has been introduced.

Alabama

  • H.512 Authorizes Pickens County to levy a 10 cent excise tax on each pack of cigarettes, as well as a 10 cent excise tax on each cigar and pack of rolling papers. Approved.
  • H.737 Authorizes Chambers County to levy a 10 cent excise tax on every pack of cigarettes and a five cent excise tax on each cigar. Approved.
  • H.798 Model Statute Legislation. Approved.
  • H.848 Raises excise tax on cigarettes by eight cents in Baldwin County. Approved.

    Alaska

  • H.37 Gray Market Legislation. Approved.

    California

  • S.2070 Allows State Fire Marshall to contract with Bureau of Home Furnishings to develop cigarette fire safety standards. Passed.
  • S.1038 Gray Market Legislation. Approved.

    Connecticut

  • S.528 Model Statute Legislation. Approved
  • S.523 Increases the state excise tax on snuff tobacco by 40 cents per ounce. Approved.
  • H.5291 Prohibits sale of cigarettes in packs of less than 20. Approved.

    Delaware

  • H.313 Gray Market Legislation. Approved.
  • S.353 Would allow businesses licensed as retailers and as another category (manufacturer, wholesaler, etc.) to avoid licensing in another category as long as gross receipts are reported as retail receipts. Introduced.

    Florida

  • H.1941 Gray Market Legislation. Approved.

    Hawaii

  • S.2486 Provides for the tax on cigarettes to be imposed and collected through excise tax stamps purchased by licensees and affixed to cigarette packages. Approved.

    Illinois

  • H.3995 Amends Cigarette Tax Act to include imported or re- imported cigarettes as purchased outside ordinary channels of trade. Approved.
  • H.4369 Prohibits the sale of Bidis. Enacted.

    Maryland

  • S.6 Prohibits the sale and manufacture of cigarettes in packs of less than 20. Approved.

    Massachusetts

  • H.5200 Would prohibit the sale of tobacco products to persons under age 19. Introduced.
  • S.2157 Model Statute Legislation. Enacted.

    Michigan

  • S.1248 Would prohibit the sale of Bidis. Introduced.

    Minnesota

  • H.4127 Allows cigarette stock in which there is no invoice proving the products were purchased from a licensed dealer to be confiscated as contraband. Approved.

    New Hampshire

  • S.450 Gray Market Legislation. Approved.

    New Jersey

  • S.1224 Would require retailers to verify age with photo identification of all customers younger than age 27. Introduced.
  • A.2357 Would raise purchasing age requirements from 18 to 21. Introduced.

    New York

  • S.7066 Prohibits the sale of Bidis. Passed.
  • S.7809 Would provide a new index for retail price adjustments for purposes of calculating prepaid sales tax. Introduced.

    Ohio

  • S.200 Grants affirmative defense to licensed tobacco retailers if a transaction scan of the purchaser’s driver’s license indicates it is valid. Approved.

    Pennsylvania

  • S.1243 Model Statute Legislation. Enacted.

    Rhode Island

  • S.2953 Would increase state excise tax by five cents per pack. Introduced.

    Vermont

  • H.636 Model Statute Legislation. Approved.
  • H.748 Gray Market Legislation. Approved.

    Washington

  • V.9 Would prohibit smoking in any public place except in a tobacco shop. Introduced.

    Wisconsin

  • S.122 Model Statute Legislation. Approved.

    Federal

  • S.2696 “Gray Market Cigarette Compliance Act of 2000” Introduced.
  • S.2493 “Tobacco Smuggling Eradication Act of 2000” designed to deter tobacco smuggling into the U.S. Introduced.
  • S.2566 “Federal Food, Drug, and Cosmetic Act” would grant the Secretary of Health and Human Services the authority to regulate tobacco products. Introduced.
  • S. 2568 Would provide FDA with certain authority to regulate tobacco products. Introduced.
  • H.R.4432 “Tobacco Free Youth Act” will raise legal smoking age from 18 to 21. Introduced.
